Court dismisses application against Deputy IGP

The High Court in Accra has dismissed an application by a lecturer seeking to prohibit COP Christian Tetteh Yohuno from performing his role as Deputy Inspector General of Police (IGP) in charge of operations. Emmanuel Felix Amantey had alleged that the police council and the presidency acted more than their powers when the two offices appointed a deputy IGP in charge of operations.

He argued that both the Constitution and the Ghana Police Service Act do not provide for such a role. The only legal document that addresses this position is the Police Service Regulation, which does not allow for a deputy in charge of operations. Consequently, he filed a judicial review application, accusing the president and the police council of committing an illegal act.

But Justice Richard Apietu in delivering his ruling on the matter indicated that the supervisory jurisdiction of the High Court was not properly invoked. He explained that while such powers of the court are concerned with adjudicatory functions exercised by lower adjudicating bodies, the President and the Police Council are not lower adjudicating bodies. Justice Apietu further argued that the President and the Police Council were exercising administrative powers.

He thus dismissed the application.
