Daddy Lumba estate battle deepens as Akosua Serwaah heads to Court of Appeal

Akosua Serwaah has lodged an appeal at the Court of Appeal in Kumasi, challenging a High Court ruling that recognised both her and Priscilla Ofori, popularly known as Odo Broni, as the lawful surviving spouses of the late highlife icon Charles Kwadwo Fosu, widely celebrated as Daddy Lumba.

In her notice of appeal, Ms. Serwaah contests the entire judgment, arguing that the trial court erred by rejecting and declaring inadmissible a marriage certificate she submitted to support her claim. She further contends that the High Court misapplied the law when it concluded that she had not met the requirements of the Evidence Act, 1975 (NRCD 323) for admitting the certificate into evidence.

Consequently, she is urging the Court of Appeal to overturn the High Court’s decision and to declare her the sole lawful surviving spouse of the late musician.

Judgment

On November 28, 2025, the Kumasi High Court, presided over by Justice Dr. Dorinda Smith Arthur, dismissed Akosua Serwaah’s claim seeking recognition as the sole surviving spouse of the late musician Daddy Lumba. The court ruled that she had not proven a marriage under the Marriage Ordinance that would entitle her to exclusive spousal status.

Instead, the evidence indicated that Daddy Lumba married Ms. Serwaah under customary law, which permits polygamy. Consequently, the court held that his subsequent marriage to Priscilla Ofori, also known as Odo Broni, was equally valid under Ghanaian law.

In conclusion, the High Court declared both Akosua Serwaah and Priscilla Ofori, alias Odo Broni, as the legally recognised surviving spouses of the late music icon.
