I am very ‘grateful’ to the Special Prosecutor for dropping case

Member of Parliament for Bawku Central Constituency Mahama Ayariga has expressed gratitude to the Special Prosecutor, Kissi Agyebeng, for entering a nolle prosequi in his case on Monday, October 11.

The National Democratic Congress (NDC) lawmaker was facing charges of tax evasion in the importation of some “luxury” vehicles.

But at the Financial Court 2 on Monday, Special Prosecutor Agyebeng said the Republic would not be able to prove its case on the standard of proof required in such a criminal case.

Mr Ayariga and six others were acquitted and discharged in May 2021 following a submission of no case by the defence lawyers in another case involving the procurement of some ambulance for his constituency.

The Special Prosecutor, in court for the first time since officially starting work on Monday, August 9, insisted that this case, started by his predecessor, would suffer the same fate upon further scrutiny of available evidence.

‘Good conscience’

Speaking to journalists after proceedings in court, lawyer of the accused Godwin Edudzi Tameklo said the development in court on Monday came as no surprise to his client since Societe Generale had made it clear that Mr Ayariga benefitted from a car loan, on which deductions had even started.

“We need to thank the new Special Prosecutor for allowing reason and fairness to prevail,” he said, pointing out that Mr Agyebeng made the move in “good conscience”.

“We are grateful to him and we are grateful to the court for what has happened today.”
