‘Headucator’ could face prosecution under anti-LGBTQ+ Bill – Sam George

The Member of Parliament for Ningo-Prampram, Samuel Nartey George, has suggested that a social commentator known as Headucator could face prosecution under the proposed Human Sexual Rights and Family Values Bill, 2025, for allegedly promoting homosexual activity.

Speaking during deliberations on the Bill on Thursday, April 23, Mr. George argued that individuals who openly identify as members of the LGBTQ+ community and advocate such conduct may fall within the scope of the legislation if it is enacted.

He cited a leaked video involving Headucator and a male partner, noting: “This gentleman can be charged on the basis of the video of male-on-male intercourse.”

Mr. George clarified that beyond the leaked video, the individual in question actively presents himself and promotes homosexual activity on his social media platforms. He argued that such conduct provides grounds for establishing both the actus reus and mens rea under the proposed law.

He explained: “You examine his activities on social media and the public commentary where he openly admits his sexual preferences. The actus reus relates to what he has done to actualize those statements, while the statements themselves serve as evidence of the mens rea.”

In legal terms, actus reus refers to the physical act of committing a crime, while mens rea denotes the mental intent behind it—both of which are required to establish criminal liability. The comments were made in the context of ongoing stakeholder engagements on the Bill, which seeks to criminalise LGBTQ+ activities in Ghana and has sparked renewed national debate.

Meanwhile, the Member of Parliament for Assin South and sponsor of the Bill, John Ntim Fordjour, has denied allegations of any sexual relationship with transgender musician Angel Maxine. The denial follows remarks by Mr George during a clause-by-clause consideration of the Bill, suggesting that individuals who publicly identify as part of the LGBTQ+ community could face prosecution should the legislation be enacted.

The Human Sexual Rights and Family Values Bill, 2025, remains under parliamentary review, with stakeholder consultations ongoing as lawmakers consider its provisions and potential implications.
