In Kumasi, High Court Judge Her Ladyship Justice Dorinda Smith-Arthur has criticised the practice of holding both ordinance and customary marriages, calling it unnecessary and a misuse of time and resources. She clarified that, according to Ghanaian law, each form of marriage is independently valid and legally recognised, so performing both ceremonies simultaneously is redundant.
Justice Smith-Arthur made this remark in passing while presiding over a case brought by Akosua Serwaa Fosuh, who is seeking a declaration that she is the sole lawful surviving spouse of the late highlife legend Charles Kwadwo Fosuh, popularly known as Daddy Lumba. The first defendant in the case is Abusuapanin Kofi Owusu, with Priscilla Ofori, also called Odo broni, listed as the second defendant. Cross-examinations of all witnesses have concluded, and the court is expected to deliver its ruling on Friday, November 28, 2025.
