The High Court (Criminal Division) has dismissed an application filed by former Finance Minister Kenneth Ofori-Atta, which challenged the legality of an arrest warrant issued by the Office of the Special Prosecutor (OSP). The ruling was delivered by Justice Lydia Osei Marfo on Wednesday, July 30, and concluded that the application lacked merit.
Mr. Ofori-Atta argued that the OSP acted unlawfully in securing the warrant, claiming that due process was not followed. He requested the court to annul all related proceedings, including an Interpol Red Notice issued against him. His legal team described the actions of the OSP as “procedurally flawed” and a violation of his constitutional rights.
In response, lawyers representing the Special Prosecutor maintained that the warrant was validly obtained and executed in accordance with the law. They asserted, “There is no evidence before this court that the OSP acted outside its mandate,” urging the court to dismiss the application.
Justice Osei Marfo ruled that there was no basis to interfere with the OSP’s actions, stating, “The application is hereby dismissed in its entirety.” She confirmed that the arrest warrant and the accompanying Red Notice remain valid and enforceable.
